As I said, the death penalty should only be given if the murder was intended. If someone killed someone from my family due to a car accident which wasn't even their fault, it would be unfair to punish that person because that person never intended to kill my family member. I would be angry at first, but I wouldn't take action.

How about car accident under the influence?
This reminds me of the show called Dexter, where the main characters kills people that have done wrong in their life, like stealing tons of money from others or killing young kids while driving intoxicated.
He feels justified for killing these people. And I think their death by his hands is justified. I don't think he deserves to die by murdering these people. Always depends on the circumstances. An eye for an eye is outdated in this case, and automatic death penalty for murder isn't always the correct choice.
I would entirely base it on the reason of the murder and the severity of the violence
